For the online Conference of the Hungarian Wine Business Programby Agrármarketing Centrum, (Agricultural Marketing Centre) for the target market of the Czech Republic

On 4th May 2021, Agrármarketing Centrum, as a body performing public tasks, will organize a business development conference in Prague, Czech Republic, one of the most important target markets of Hungarian wine exports.

Purpose:

– to help the introduction of producers and wines that are already present on the Czech market, this time with a focus on further strengthening their business relations,

– as well as to help wineries that plan to expand their export activities to the Czech wine market in the future.

This Notice applies to personal data processed in preparation for the business development meeting organized by the AMC. As the organizing company/organization, the AMC does not perform automated decision-making or profiling in connection with data processing.

Importers, distributers, journalists and purchasers will be invited to the event.

The legal basis for data processing

Data processing is based on point e) of Article 6(1) of Regulation 2016/679 EU of the European Parliament and of the Council (hereinafter: GDPR), and the Government proceeds within its legislative powers set forth in Section 15(3) of the Fundamental Law and, with respect to Section 7, based on its authorisation Act No. XVII of 2007 on certain issues of procedures in relation to support for agricultural, rural development and fisheries and to other measures and Government Decree 118/2016. (VI. 6.) on Community Agricultural Marketing.

The source of the personal data and the scope of the data processed, where they are not provided by the data subject

As the organizing company/organization, Agrármarketing Centrum will process the data submitted to the registration site set up for registering to the online conference organized for the target market of the Czech Republicat https://hunwinebusiness.com/ until 23rd March 2021.

The recipients and categories of recipients of the personal data

Agrármarketing Centrum, as an organizing company/organization, in order to administer the tasks related to the organization of the business conference – e.g. registration, website management -, will use the services of WineGlass Communication Kft. The period for which the personal data will be stored

As the organizer, Agrármarketing Centrum will process personal data until 24th March 2021.

2.2 Assessing the effectiveness of the conference, follow-up

purpose of data processing: to ensure professional contact and monitor the effectiveness of the meeting

The legal basis for data processing

Point a) of Article 6(1) of Regulation 2016/679 EU of the European Parliament and of the Council (hereinafter: GDPR), the data subject’s consent to the processing of their personal data for specific purposes.

Section 4/B (2) of Act XVII of 2007 In agricultural subsidy proceedings, the consent of the customer to the processing of their personal data required in the proceedings shall be deemed to be given for the purpose of fulfilling the submitted request, also with regard to the personal data provided to the extent necessary for that purpose.

As the organizing company/organization, Agrármarketing Centrum stores the data provided during registration by the partners participating in the online conference organized for the target market of the Czech Republic.

The recipients and categories of recipients of the personal data

As the organizing company/organization, Agrármarketing Centrum does not use the services of a data processor to monitor the success of the business conference or to maintain professional contacts.

The period for which the personal data will be stored

As the organizing company/organization, Agrármarketing Centrum processes the data provided during registration by the partners participating in the online Hungarian Wine Business Program organized for the target market of the Czech Republic for the purpose of follow-up and professional contacts until withdrawal of their consent.

Article 7(3) of the GDPR Thedata subject has the right to withdraw their consent at any time. The withdrawal of consent shall not affect the lawfulness of processing that was carried out based on consent before its withdrawal.

3.The data subject’s rights relating to data processing

3.1. Deadline

As the organizing company/organization, Agrármarketing Centrum shall fulfill the data subject’s request to exercise their rights within a maximum of one month from its receipt. The date of receipt of the request does not count towards the deadline. Agrármarketing Centrum shall inform the data subject of any such extension within one month of receipt of the request, together with the reasons for the delay.

3.2. The data subject’s rights relating to data processing

3.2.1. Right to access

The data subject has the right to obtain from the controller information through the contact details provided in Section 1 as to whether or not personal data concerning him or her are being processed, and, where such data processing is in progress, to be informed about the following:

– which of their personal data is processed by the controller; on what legal basis; for what data processing purpose; for how long;

– which of their personal data is made available for access or transmitted by the controller to whom, when, under what law;

– what sources their personal data comes from; and

– whether the controller applies automated decision-making, its logics including profiling. At the data subject’s request, the controller shall provide the data subject with a copy of the personal data undergoing processing free of charge for the first time and then it may charge a reasonable fee based on its administrative expenses. In order to comply with data security requirements and protect the rights of the data subject, the controller is obliged to make sure that the data subject and the person wishing to exercise the right of access are identical; therefore, the data subject must be identified before providing any information or giving access to the data or issuing a copy of the same.

3.2.2. Right to rectification

The data subject may request the controller to rectify any inaccurate personal data of the data subject, or to supplement any missing data.

3.2.3. Right to block (restrict processing of) data

The data subject may request, through the contact details provided in Section 1, that the processing of their personal data be restricted by the controller (clearly indicating the limited nature of the processing and ensuring separate processing from other data) if the data subject – disputes the accuracy of their personal data (in which case the controller shall restrict data processing for such time as is needed for checking the accuracy of the personal data); – the processing is unlawful and the data subject opposes the erasure of the personal data and requests the restriction of their use instead; – the controller no longer needs the personal data for the purposes of the processing, but the data subject requests the same for the assertion, exercise or defense of legal claims; or – the data subject has objected to processing; in this case such restriction shall be valid until it is determined whether the legitimate grounds of the controller override those of the data subject.

3.2.4. Right to object

The data subject may object to the data processing through the contact details provided in Section 1 if, in their opinion, the controller would not properly process their personal data in connection with the purpose indicated in this privacy notice. In this case the Controller shall demonstrate the compelling legitimate grounds for the processing of data which override the interests, rights and freedoms of the data subject or which are related to the assertion, exercise or defense of legal claims.

3.2.5. Right to Erasure

In relation to the data processing covered by this notice, the data subject may exercise their right to erasure only if the data is not needed for the performance of the task carried out in the public interest vested in the controller.

4.Right to legal remedy

If the data subject considers that the data controller has violated the applicable data protection requirements during the processing of their personal data, they may submit a complaint to the Authority (National Authority for Data Protection and Freedom of Information, address: 1055 Budapest, Falk Miksautca 9-11., postal address: 1363 Budapest, Pf. 9. e-mail: ugyfelszolgalat@naih.hu, website: www.naih.hu), or have the opportunity to apply to a court to protect their data which will proceed with urgency in the case.

In this case, the data subject may freely decide whether to bring an action before the court having jurisdiction according to the data subject’s home address (permanent address) or place of residence (temporary home address) or the registered office of the Authority.
